Evidence from cell phones being used in divorce trials

Recent research reveals that 90 percent of divorce lawyers agree that the use of evidence from cell phones is increasing and becoming more important in divorce cases . This type of evidence can come in the form of text messages, call history, photos, videos, emails, and more.

Text and photo evidence from cell phones can often display the true state of relationships, making them more credible to a court.  In addition, little evidence is generally presented in divorce cases, so text messages and other mobile phone evidence are sometimes the relied on evidence in a trial.

One lawyer stated, “You can document anything at any time in real time. People are taking pictures with their phone as events are happening. Text messages: people are saving text messages, taking pictures of text messages so you don’t lose them and can submit them to a judge.”

Demi Moore files for divorce from Ashton Kutcher

After weeks of speculation that actors Demi Moore and Ashton Kutcher were getting a divorce, Moore has confirmed the rumors by filing for divorce.  The couple has not cleared up whether or not reports of Kutcher cheating on Moore are true or not.

Moore, 49, and Kutcher, 33, were married in September 2005.  The actors’ marriage surprised many because of their 16-year age difference.

Kutcher became the step-father to Moore’s three daughters from her previous marriage to actor Bruce Willis.  Moore and Kutcher also created an organization together that makes efforts to stop the sexual exploitation of girls called the DNA Foundation.

Moore did not address the reason for the divorce filing, but a statement from the actress suggests infidelity on Kutcher’s part.  Moore said, “As a woman, a mother and a wife there are certain values and vows that I hold sacred, and it is in this spirit that I have chosen to move forward with my life.”

Report reveals marriage and divorce rates in U.S.

A recent report from the U.S. Census Bureau details marriage and divorce rates in different regions of the United States.  According to the report, states in the South had both the highest marriage and divorce rates.

On the contrary, states in the Northeast were found to have the lowest marriage and divorce rates.  New Jersey was the state with the lowest marriage and divorce rate for both men and women.

The data used in the report was collected from 3 million households that participated in the 2009 American Community Survey.

Authors of the report say the most striking thing they found was that the average age to get married at in the United States has increased to 28.4 years for men and 26.5 years for women.

Maria Shriver files divorce papers

Earlier this month, Maria Shriver filed divorce papers in the Los Angeles Superior Court.  The filing came just 6 weeks after the world learned of her husband’s infidelity.

Maria Shriver and Arnold Schwarzenegger married in 1986.  In the divorce filing, Shriver cites irreconcilable differences as the reason for the divorce.

In addition, in the filing, Shriver seeks spousal support and joint custody of her and Schwarzenegger’s two youngest children.  Although property is expected to be divided equally, the former California governor has expressed intent to give Shriver more than 50 percent of their marital assets.

So far in the divorce settlement, the only thing that has been decided upon is that Schwarzenegger will keep their family home in Brentwood, California.

Study suggests unemployed men more likely to divorce

A study recently published in the American Journal of Sociology reveals that unemployed men are more likely to divorce than employed men and both employed and unemployed women.

The study used data from 3,600 couples from the National Survey of Families and Households.  The data covered 1987-1988, 1992-1994, and 2001-2002.  The research was led by a professor at Ohio State University.

The study states, “Women’s employment has increased and is accepted, men’s non-employment is unacceptable to many and there is a cultural ambivalence and lack of institutional support for men taking on ‘feminized’ roles such as household work and emotional support.”

Researchers found that unemployment increases a man’s chances of divorce initiated either by his wife or himself.  Furthermore, unemployed men were more likely to divorce even if they were happy in their marriage.

Study shows long commutes increase risk of divorce

According to a divorce study conducted by a team of Swedish researchers, married couples with a spouse who has a long commute to work or school are at greater risk of divorcing.  The researchers concluded that couples with a commuter are 40 percent more likely to divorce than couples with only a short commute to the office.

Furthermore, the study shows that couples are most affected in the first few years of commuting.  Once a spouse has been taking a long commute for around 5 years, the risk of divorce decreases.

In addition, researchers discovered that in married couples with a spouse that takes a long commute, negative gender stereotypes are often reinforced.

According to the Loyola University Health System, Facebook is to blame for 1 our of every 5 U.S. divorces.

Not only is Facebook to blame for divorces in the U.S., lawyers have also said that social media is used as evidence in divorce cases today. Although many believe that Facebook can not be the only factor in ending marriage, but it can have an affect on a strained marriage.

Online chatting with an old friend or acquaintance can sometimes lead to a full on affair. Facebook and other social media sites are online social tools that can help single people meet others. January considered divorce month in Colorado
