Maintenance, also known as alimony, can be awarded to one spouse in a divorce if his or her earning ability is substantially less than that of the other spouse’s. The court considers multiple factors in determining whether or not to award alimony.
The court uses its discretion to determine whether one spouse should receive alimony after considering very specific factors, including the length of the marriage, the difference in earning abilities of the spouses, the financial needs of each spouse, the spouses’ level of education and experience, the lifestyle led by the spouses during the marriage, and each spouse’s health. This is usually determined at the Permanent Orders hearing. There is no formula for determining alimony maintenance, regardless of the spouses’ incomes.
At the Temporary Orders stage of a divorce, spouses whose combined income is $75,000 or less will have maintenance determined by a formula, but there is no formula if the combined income exceeds $75,000.
