After a divorce, If you or your former spouse wants to move to another state or area that will affect your existing parenting time schedule, the parent that wants to relocate must notify the other parent in writing. That notification must include specific information, including the reason for the proposed move, the location of the proposed move and a proposed revised parenting time schedule.

If you and your former spouse aren’t able to agree about the relocation, the person that wishes to relocate must file a request, or motion, with the court and obtain court approval for the move. Once the request is filed, the court will set a hearing to allow both parties to present their reasons for and against the move.

The court must consider numerous factors in determining whether to grant a request to relocate, including the reasons for the move, the reasons for the objection to the move, the history and quality of each parent’s relationship with the children, educational opportunities available at the existing and proposed locations, the presence or absence of extended family at the existing and proposed locations, the impact of the proposed move on the children, and other factors.
