The Lawsuit Process

Normally, the legal process occurs in the following order:

  • Both parties trade necessary case-related paperwork
  • Depositions are taken of both the claimant and defendant
  • The insurance company or defendant has the right to request an independent medical evaluation
  • Finally, the case goes to trial

At any point in time, either side may offer a settlement to end the lawsuit. If the settlement is accepted, the lawsuit will end and that claimant won’t be allowed to sue the defendant again for the same injury.
