Amtrak accident victim sues trucking company

A 38-year old attendant on the Amtrak train that was struck by a semi-truck in Nevada last week has sued the trucking company.  The passenger suffered serious and permanent injuries, as did dozens more.  6 people were killed in the tragic truck accident.

The lawsuit names the trucking company and the driver that was driving the truck involved in the accident as defendants and seeks more than $10,000 in damages for mental and physical suffering.  The lawsuit states that the driver “negligently and carelessly failed to heed railroad warning signs and crashed into the westbound California Zephyr Amtrak train.”

In the accident, the truck crashed through the arms of a railroad crossing and into the train carrying around 110 people.  Investigators from the National Transportation Safety Board are unsure of why the driver ignored or did not see the railroad signs or the train’s lights.  Investigations could take up to a year, but initial findings suggest that the truck driver was negligent for braking only 320 feet before the accident.
