Q: What’s the best process for hiring a personal injury attorney?

A: When you hire anyone for anything, the interview process is one of the most important parts of the process. If you are meeting with several lawyers, have some general questions ready to ask them, such as:

  • Do you often handle matters such as mine?
  • What is your success rate with this kind of claim?
  • Will you go to trial if necessary?
  • Do you need to hire outside attorneys or will my case be handled in-house?
  • Can I see some of your testimonials?
  • What’s the usual payout for a claim like mine?
  • How much will I need to pay you?

Anything that you deem important to know, should be asked. And sometimes, even if the attorney’s answers are all on point, there’s just no chemistry or you feel uncomfortable talking about personal matters with him or her. That’s okay, too. Q: Do I have a case if I don’t have any injuries or feel hurt after an accident?

A: A larger number of people don’t think they are injured when asked at the scene of the car crash. Generally within the next few hours or even the next day, pain and problems can be revealed. Your adrenaline rush may be masking your injury, or your pain may be delayed. It is important that you see a physician as quickly as possible once you recognize that you are hurt.

 

Q: What are the kinds of damages I can seek after an injury due to another’s carelessness?

A: At Hull & Zimmerman, we will investigate your case thoroughly and seek damages accordingly. There are three kinds of damages we can try to get you:

  • Economic damages: damages based on tangible data such as, medical bills, lost income (present and future), property loss, ongoing medical treatment, etc.
  • Non-economic damages: this type of compensation is based on more subjective matters, such as pain and suffering, mental and emotional trauma, and a loss of quality of life
  • Impairment: This is compensation for a body part no longer functioning as it did before injury. It is separate from pain. For example, if you have a rotator cuff tear in your shoulder, it will hurt which is pain and suffering. Because of the tear, you can no longer lift your arm above your shoulder. That is impairment.
  • Punitive damages: this is less common and only relevant if the defendant acted intentionally or with reckless disregard for others safety. In most cases, we seek and receive both economic and non-economic damages for our clients.

 

Q: I was injured in an accident caused by someone else, but I have a pre-existing condition, can I still file a claim against the negligent party?

A: You can and should still file a claim, even if you have a pre-existing condition. Your damages sought will take into consideration your pre-existing health issues. If the other party aggravated the injury or condition they can be held responsible. These kinds of cases are often a bit more complex and a skilled personal injury attorney will be able to navigate through the process easier than you can alone. If expert witnesses are necessary to prove your case, hiring a legal team that has the proper resources will benefit your outcome.
